O presente estudo em homenagem à professora Maria dos Remédios Fontes Silva trata do tema do acesso à justiça para microempresas e empresas de pequeno porte como efetivação dos direitos fundamentais. Nesse contexto, serão abordados a importância da função social da empresa como sujeitos de direitos, bem como sua relevância socioeconômica e a necessidade de sua preservação sob a ótica da hermenêutica constitucional. O estudo do tema escolhido é importante, considerando que essa categoria de empresa é célula fundamental na valorização do trabalho humano e no desenvolvimento nacional. Para tanto, pretende-se definir alguns institutos para compreensão dos objetivos do presente trabalho e, por meio de pesquisa bibliográfica, legislativa, e pelo método hipotético-dedutivo, busca-se conceituar a empresa e sua importância sob a ótica constitucional, diagnosticar sua relevância socioeconômica, sua dimensão e função social e a necessidade do tratamento diferenciado como garantia do acesso à justiça.
The present study, in honor of Professor Maria dos Remédios Fontes Silva, deals with the issue of access to justice for micro and small businesses as a realization of fundamental rights. In this context, the importance of the company's social function as subjects of rights will be addressed, as well as its socioeconomic relevance and the need for its preservation from the perspective of constitutional hermeneutics. The study of the chosen theme is important, considering that this category of company is a fundamental cell in the valorization of human work and in national development. Therefore, it is intended to define some institutes to understand the objectives of this work and, through bibliographical, legislative research, and by the hypothetical-deductive method, we seek to conceptualize the company and its importance under the constitutional perspective, diagnose its relevance. socioeconomic status, its social dimension and function, and the need for differentiated treatment as a guarantee of access to justice.
