A obra de Herbert Hart, intitulada “O Conceito de Direito”, publicada inicialmente em 1961, é uma das mais importantes para a Teoria e a Filosofia do Direito, representando uma grande contribuição para o estudo de diversos temas. Embora seja suscetível de várias críticas, não se pode negar o legado incomensurável deixado por esse autor, que pode ser colocado ao lado de Hans Kelsen e de Alf Ross como um dos maiores jusfilósofos do século passado. O presente estudo busca examinar apenas dois temas dessa obra: aspecto interno e o ponto de vista interno e externo. Objetivar-se-á gizar os conceitos, enfatizando o significado e importância que apresentam na obra do autor epigrafado. Uma análise crítica da matéria também será apresentada, em uma tentativa de estimular o debate e a discussão acerca da grande contribuição dada por Hart sobre a matéria.
Herbert Hart's work, entitled "The Concept of Law", initially published in 1961, is one of the most important for the Theory and Philosophy of Law, representing a great contribution to the study of several themes. Although it is susceptible to several criticisms, one cannot deny the immeasurable legacy left by this author, who can be placed alongside Hans Kelsen and Alf Ross as one of the greatest legal philosophers of the last century. This study seeks to examine only two themes of this work: internal aspect and the internal and external point of view. The aim will be to outline the concepts, emphasizing the meaning and importance they present in the work of the aforementioned author. A critical analysis of the subject will also be presented, in an attempt to stimulate debate and discussion about the great contribution made by Hart on the subject.
