Na sociedade contemporânea, a proteção ao meio ambiente assume grande relevância. A tendência é de constitucionalizá-la, o que pode ser feito por diferentes modelos, tornando-a direito fundamental, como no Brasil, por exemplo, ou tornando-a um dos objetivos do Estado, sem a caracterização como direito fundamental, como na Alemanha. A opção por qualquer dos modelos, por si só, não garante a efetividade da proteção ao meio ambiente, devendo a escolha recair sobre o formato que melhor atenda as peculiaridades de cada ordem jurÃdica.
In contemporary society, the protection of the environment has great
importance. The trend is constitutionalises it, which can be done by different models,
making it a fundamental right, as in Brazil, for example, or making it one of the state’s
goals without the characterization as a fundamental right, as in Germany. The choice of
either model alone does not guarantee the effectiveness of environmental protection, and
the choice must falls on the format that best meets the peculiarities of each national law
