O exercício do poder de polícia judiciária reflete uma das formas de atuação da administração pública. Enquanto a polícia administrativa exerce uma atividade que se exaure em si mesma, a polícia judiciária preside a apuração dos elementos de provas para avaliação do órgão titular da ação penal, no caso o Ministério Público, ou para eventual prestação jurisdicional. Assim, a natureza jurídica da atividade exercida pela polícia judiciária é de função administrativa.
The exercise of judicial police power reflects one of the ways in which the public administration operates. While the administrative police carry out an activity that ends in itself, the judicial police preside over the investigation of evidence for evaluation by the body that is responsible for criminal prosecution, in this case the Public Prosecutor's Office, or for eventual judicial provision. Thus, the legal nature of the activity carried out by the judicial police is that of an administrative function.
