Enquanto objetivo do presente estudo, tem-se de realizar uma análise acerca da decisão do Supremo Tribunal Federal em considerar o estado de coisas inconstitucional do sistema carcerário brasileiro, tendo em vista, principalmente o tratamento desumano destinado aos encarcerados, seja pelas condutas omissivas ou comissivas por parte do poder estatal. Debruçados em materiais bibliográficos que acentuam a temática, assim como trazem à reflexão críticas acerca do cárcere no Brasil, suas consequências e problemáticas, tudo, conforme aduz o título, com a intenção de serem breves apontamentos sobre o assunto com o cerne de esclarecer se há assertividade na referida decisão.
As the objective of the present study, an analysis was carried out regarding the decision of the Federal Supreme Court to consider the unconstitutional state of affairs of the Brazilian prison system, taking into account, mainly, the inhumane treatment of those incarcerated, whether due to omissive or commissive conduct. by state power. Focused on bibliographic materials that accentuate the theme, as well as bringing up criticisms about prison in Brazil, its consequences and problems, all, as the title suggests, with the intention of being brief notes on the subject with the core of clarifying whether there is assertiveness in said decision.
