O presente artigo tem como objeto de pesquisa os efeitos e fenômenos decorrentes do uso de novas tecnologias no campo das ciências criminais com o intuito de antecipação de riscos e notadamente, pela política criminal da prevenção, a antecipação do campo da tutela penal. Tal efeito é perceptível desde uma lógica penal material, até processual penal. Materializa-se tanto na tipificação de condutas indesejáveis (ainda que sem ofensa a bens jurídicos) quanto na criação de institutos persecutórios, de alcance de informações privadas por meio de dados. No campo de persecução penal, observa-se que a utilização de algoritmos para o alcance irrestrito de informações possibilita a virtualização do sistema processual autoritário, na medida em que nota-se a constante permanência de transformação do sujeito processual em objeto de prova. A metodologia utilizada é a bibliográfica, bem como utiliza-se de ilustração por ferramenta QR-CODE para trazer ao leitor o avanço tecnológico mundial atual.
This article has as its research object the effects and phenomena resulting from the use of new technologies in the field of criminal sciences in order to anticipate risks and, notably, through the criminal policy of prevention, the anticipation of the field of criminal protection. Such an effect is noticeable from a material penal logic, up to criminal procedural. It materializes both in the typification of undesirable behaviors (although without offending the legal good), and in the creation of persecutory institutes, to reach private information through data. In the field of criminal prosecution, it is observed that the use of algorithms for the unrestricted access of information enables the virtualization of the authoritarian procedural system, insofar as it is noted the constant permanence of transformation of the procedural subject into evidence. The methodology used is the bibliographic one, as well as it uses illustration by QR-CODE tool to bring to the reader the current world technological advancement.
