O presente artigo tem como objetivo discutir a questão jurídica que envolve o FUNDEB e os seus reflexos nas esferas da União, dos Estados, do Distrito Federal e dos Municípios. Tendo como foco o direito à educação, analisase a estrutura de financiamento da educação prevista na Constituição Federal, por meio de dois acórdãos julgados no Senado Federal em relação a constitucionalização dos fundos de financiamento da educação básica, o FUNDEF e o FUNDEB. Conclui-se que o estudo sore o financiamento educacional, neste caso, o FUNDEB demonstra o quão dificil é enfrentar as desigualdades regionais que, anualmente, se intensificam e constituem um entrave econômico para o desenvolvimento do país.
This article aims to discuss the legal issue involving FUNDB and its reflexs in the spheres of the Unios, the States, the Federal District and Municipalities. Focusing on the right to education, we analyse the education financing structure provided for in the Federal Constitution, through two judgments judged in the Federal Senate regarding the constitutionalization of the basic education funding funds, FUNDEF and FUNDEB. It’s concluded that the study on educational funding, in the case, FUNDEB demonstrates how difficult it’s to face regional inequalities that, each year, intensify and constitute na economic barrier to the contry’s development.
