O objetivo deste trabalho é apresentar o instituto do juramento decisório, como concebido no direito italiano, suas características e funcionamento para, após, verificar sua compatibilidade com o ordenamento jurídico brasileiro. Para tal, realizar-se-á uma revisão bibliográfica, incluindo a doutrina, jurisprudência relevante e dispositivos legais do sistema de origem. O juramento será objeto de uma contextualização histórica, seguida da explica-ção de seu funcionamento no direito italiano hodierno. Após, far-se-á um confronto com o direito brasileiro, tendo por prisma o Estado Democrático de Direito, o conceito de devido processo neste modelo e a definição de Fazzalari de procedimento, demonstrando o papel da prova no iter lógico de formação do provimento jurisdicional, para atender às exigências de legitimidade e fiscalização próprias do processo democrático.
The goal of this paper is to present the legal device called Decisory Oath, as con-ceived by Italian Law, regarding its characteristics and operation, with a view to assess its compatibility with the Brazilian legal system. To do so, a bibliographic review will be per-formed, including applicable legal authors, jurisprudence and legal provisions from the sys-tem of origin. Subsequently, the Legal Oath will be historically contextualized, and the out-lines of its operation within present Italian Law will be provided. Afterwards, it will be subject to comparison with Brazilian Law, through the lenses of the Democratic State gov-erned by the Rule of Law along with the Due Process that follows,and the concept of Procedure formulated by Fazzalari, by means of which the central role played by Evidence in the logical iter that precedes a legal act shall be demonstrated, regarding the fulfillment of the demands of legitimacy and accountability, inherent to the concept Democratic Due Process.
