O objetivo deste estudo é analisar o direito fundamental referente às questões jurídico-patrimoniais entre os homossexuais. A Constituição Federal de 1988 é um marco de ampliação dos direitos dos cidadãos, garantindo a consolidação de direitos a todos os excluídos pelas leis ordinárias. O método dedutivo possibilitou que partíssemos dos princípios constitucionais para os casos concretos, fazendo um passeio pela doutrina jurídica. Como resultado do trabalho, fica evidente que uma parte dos operadores do direito admite a possibilidade de discussão do tema levando em consideração os direitos dos homossexuais.
The objective of this study is to analyze the fundamental right regarding the juridical-patrimonial among the homosexuals. The Federal Constitution of 1988 is a mark of enlargement of the citizens’ rights, guaranteeing the consolidation of rights to all who were excluded from the ordinary laws. The deductive method has made possible that we have left of the constitutional beginnings for the concrete cases, according to literature. As a result of the study it is evident that a part of the operators of the law admits the possibility of discussion of the theme with favorable opinion to the homosexuals.
