O presente estudo busca uma reflexão acerca do tratamento jurídico dado ao nascituro, o que traz consequências de natureza humana e patrimonial, as teorias que tratam sobre o assunto se mostram ou insuficientes para o tratamento humano ou contraditórias dentro de uma análise civil-constitucional. Com o surgimento de novas técnicas de reprodução humana e com a necessidade de proteção dos interesses do ser humano que se encontra no ventre materno, é preciso repensar o sistema protetivo do nascituro.
The present assay seeks a reflection on the legal treatment given to the unborn child, which brings consequences of his human condition and patrimonial rights, theories that deal with the subject are shown insufficient for human treatment or contradictory within a civil-constitutional analysis. With the new techniques of human reproduction and the need to protect the interests of the human being in the womb, it is necessary to rethink the protective system of the unborn child.
