O presente artigo trata dos efeitos provenientes da condenação e das consequências jurídicas extrapenais da sentença condenatória, aludidos nos artigos 91 e 92 do Código Penal, os quais referem os efeitos genéricos e específicos, respectivamente. Visa-se uma abordagem das implicações da sentença condenatória, uma vez que esta não gera apenas efeitos penais, atinge, também, a esfera cível (a indenização do dano, a perda de bens, a incapacidade de exercer o poder familiar), administrativa (a perda de cargo ou função pública, a inabilitação para dirigir veículo) e política (a perda do mandato eletivo) do indivíduo condenado. Posteriormente, faz-se uma análise das implicações advindas da reabilitação do condenado, elencando os pressupostos e os requisitos, para que possa vir a ser considerado reabilitado, bem como as possibilidades de revogação, ponderando, por fim, ser ou não eficaz a reabilitação. Destarte, este trabalho discute os efeitos extrapenais resultantes da condenação, assim como o que acontece com o condenado pós-cumprimento da pena.
This article deals with the effects from the condemnation and extra criminal legal consequences of conviction, alluded to in Articles 91 and 92 of the Penal Code, which refer to the generic and specific effects, respectively. The aim is to approach the implications of the judgment, since this not only creates criminal purposes, reaches also the civil sphere (compensation of the damage, the loss of property, the inability to exercise parental authority), administrative (loss of office or public function, the disqualification to drive vehicle) and political (the loss of elective office) of the convicted person. Subsequently, it is an analysis of the implications arising from the rehabilitation of the convict, listing the conditions and requirements, so that might be considered rehabilitated, as well as the revocation of possibilities, considering finally be effective or not rehabilitation. Thus, this paper discusses the extra criminal effects of the conviction, as well as what happens to the offender after serving the sentence.
