The aim of this study is to present affective jurilinguistics as a new domain of multidisciplinary research belonging to the fields of applied linguistics and law and aiming to identify and analyze the characteristics of the linguistic and extra-linguistic environment (socio-cultural, political, psychological, etc.) of acts of legal communication, in order to shed light on their motivations and consequences. The methodology proposed by affective jurilinguistics is based on the unilingual and multilingual investigation of legal terms and discourse, being intended for language and law professionals, and whose results may help them in their work within our societies structured by affect and emotion. Thus, within the framework of an affective jurilinguistics approach, it will be possible to study the origins and socio-affective consequences of the coining of legal neologisms, the semantic and pragmatic aspects of legal discourse, the metaphors surrounding legal terms and concepts, the reactions of language and legal experts and non-experts to legal neologisms, the potential for a legal term to evolve within a given social group, as well as its exportation potential to other languages and legal cultures, and the challenges faced by legal translators as the translated text triggers or reveals their affective involvement in the topic. To sum up, in order to achieve a thorough understanding of how legal language-cultures evolve, researchers and experts may find it useful to approach human sensitivity and its role in shaping our realities in today's globalized and interconnected societies.
L’objectif de cette étudeest de présenterla jurilinguistique affective comme un nouveau domaine de recherche pluridisciplinaire qui appartient aux domaines de la linguistique appliquée et du droit et qui vise à identifier et à analyser les caractéristiques de l’environnement linguistique et extra-linguistique (socio-culturel, politique, psychologique, etc.) des actes de communication juridique, afin de mettre en lumière leurs motivations et leurs conséquences. La méthodologie proposée par la jurilinguistique affective est fondée sur une approche d’investigation unilingue ou multilingue des termes et des discours juridiques qui s’adresse aux professionnels de la langue et du droit et dont les résultats pourront les aider dans leur travail au sein de nos sociétés structurées par l’affect et l’émotion. Ainsi, dans le cadre d’une approche en jurilinguistique affective il sera possible d’étudier les origines et les conséquences socio-affectives de l’apparition des néologismes juridiques, les aspects sémantiques et pragmatiques du discours juridique, les expressions imagées autour des termes et concepts juridiques, les réactions des initiés et des non-initiés à l’apparition des néologismes juridiques, le potentiel d’évolution d’un terme juridique au sein d’un groupe social donné, ainsi que son potentiel d’exportation vers d’autres langues-cultures juridiques, les défis des traducteurs juridiques lorsque le texte traduit laisse transparaître leur implication affective dans l’acte de traduire. Pour conclure, à l’heure de la mondialisation, dans nos sociétés réticulaires, une compréhension approfondie de la manière dont évoluent les langues-cultures juridiques ne saurait se passer d’une approche de la sensibilité humaine et de son rôle dans la construction de nos réalités.
