O conceito de livre-arbÃtrio desempenha, sabidamente, um papel muito importante no direito penal, sobretudo no âmbito da teoria do delito. No presente artigo, apresento a crÃtica filosófica à noção de livre-arbÃtrio, sobretudo na obra do pensador alemão Ludwig Feuerbach. Procurei mostrar como ele tematiza esse conceito, em um diálogo crÃtico com a posição de Kant. No lugar da autodeterminação kantiana, Feuerbach defenderá a necessidade natural, à qual a vontade está submetida.
It is well-known that the concept of free will plays a role of considerable importance in Criminal Law, especially in the area of the Theory of Crime. The aim of this article is to present the philosophical critique of the notion of free will in the work of German thinker Ludwig Feuerbach. I show how he thematizes this concept in a critical dialogue with Kant’s position. Instead of Kantian self-determination, what Feuerbach defends is natural necessity, that to which will is submitted.
