O presente trabalho investiga o fenômeno da judicialização da saúde na Corte Interamericana de Direitos Humanos, notadamente em virtude do caso Clí-nica Pediátrica da Região dos Lagos vs. Brasil, encaminhado, recentemente, pela Comissão Interamericana de Direitos Humanos. A relevância do presente estudo mostra-se pela necessidade de discussão do fenômeno da judicialização da saúde em âmbito interno e interamericano. Nesse passo, este artigo propõe-se a analisar quais são as violações constantes no caso Clínica Pediátrica da Região dos Lagos e verificar quais foram as medidas recomendadas pela Comissão Interamericana de Direitos Humanos que não foram realizadas, o que incidiu o seu encaminhamento ao Tribunal Interamericano. O método de abordagem é o dedutivo, com técnica de pesquisa a bibliográfica e a jurisprudencial, estudando--se, primeiramente, o processo da judicialização do direito à saúde na Corte IDH, para, posteriormente, ser respondido o problema. Em conclusão, tem-se que, no caso aqui estudado, observam-se as violações contra o direito à vida, à integridade pessoal, às garantias judiciais, aos direitos das crianças, à igualdade, à proteção judicial e à saúde.
This paper investigates the phenomenon of the judicialization of health in the Inter--American Court of Human Rights, notably due to the case Clínica Pediátrica da Região dos Lagos v. Brazil, recently forwarded by the Inter-American Commission on Human Rights. The relevance of this study is shown by the need to discuss the phenomenon of the judicialization of health in the domestic and inter-American spheres. In this step, this article proposes to analyze the violations that were constant in the Clínica Pediátrica da Região dos Lagos case and to verify which measures recommended by the Inter-American Commission onHuman Rights were not implemented, which led to its referral to the Inter-American Court. The method of approach is deductive, with bibliographical and jurisprudential research techniques, first studying the process of the judicialization of the right to health in the Inter-American Court of Human Rights, and then answering the problem. In conclusion, it is clear that, in the case studied here, violations against the right to life, personal integrity, judicial guarantees, children’s rights, equality, judicial protection and health are observed.
