Esta pesquisa pretende analisar os casos de descobertas de trabalho escravo e/ou trabalho forçado no Brasil, com o escopo de verificar se os direitos sociais insculpidos na Constituição de 1988 se efetivam para uma minoria cuja condição de vida impede melhorrenda, grau de instrução e, consequentemente, de usufruir os direitos fundamentais e sociaisconstitucionalmente garantidos. Por meio de pesquisas busca-se um case que foi estopim paraa reação do Estado às questões de direitos humanos violados, procurando-se levantar dúvidas sobre a efetividade de tais direitos. Por fim, identificará se há dificuldade à efetividade dosDireitos Fundamentais e Sociais e proporá um diálogo internacional pelo neoconstitucionalismoe transconstitucionalismo para resolução desses problemas.
This research analyzes the cases of discovered or slave labor and forced labor in Brazil, with the scope to verify that inscribe social rights in the Constitution of 1988, become effective for a minority whose condition of life impedes a better income, education and therefore enjoy the constitutionally guaranteed social rights. Through research and a case that was the trigger for the reaction of the state violated human rights issues seeks to raise doubts about the effectiveness of such rights. It identifies the difficulty the effectiveness of social and fundamental rights and is proposed by an international dialogue and neoconstitutionality transconstitucionalism for resolving these problems.
