O presente trabalho, na perspectiva do Direito Sanitário, bem como dos diplomas nacionais que tratam da saúde no Brasil, visa apresentar como se dá a política pública de acesso aos medicamentos pela população brasileira, na interface com o direito fundamental à saúde. O estudo, de caráter qualitativo, valeu-se de método bibliográfico, por meio de comparação da doutrina e legislação pátria para a composição da pesquisa. Depreende-se, a partir deste, que o Sistema Único de Saúde fornece medicamentos como parte da política pública de saúde que garante o direito fundamental social à saúde, reconhecendo a importância do acesso universal aos tratamentos necessários. Entretanto, o crescimento da judicialização de pedidos de medicamentos impõe desafios à sustentabilidade do sistema e à garantia de direitos coletivos. Assim, surgiu o Tema 6 do STF para regular o ajuizamento de ações da temática. Conclui-se que o fornecimento de medicamentos está intrinsecamente ligado ao direito à saúde e é fundamental que sua distribuição pelo SUS seja realizada com cautela.
From the perspective of Health Law, as well as the national legislation that deals with health in Brazil, this paper aims to present how the public policy of access to medicines for the Brazilian population works, at the interface with the fundamental right to health. The study, which is qualitative in nature, used a bibliographical method, studying doctrine and legislation in the country to compose the research. It emerges from this that the Unified Health System provides medication as part of the fun-damental right to health, recognizing the importance of universal access to necessary treatments. How-ever, the growth in the judicialization of requests for medicines poses challenges to the sustainability of the system and the guarantee of collective rights. Thus, Theme 6 of the STF was created to reduce the number of lawsuits filed on this subject. It is concluded that the supply of medicines is intrinsically linked to the right to health and it is essential that their distribution by the System is carried out with caution.
