O acórdão proferido pelo Supremo Tribunal Federalna ADI 5.127condenou a prática das "caudas legislativas" ou emendas jabutisque são os atos de inserir emendas que não tenham pertinência temática com o projeto de medida provisória proposto pelo Presidente da República.Trata-se de prática dotada de vícios graves de inconstitucionalidade, oque foi declarado pelo STF, no entanto, a decisão foi modulada e não afetou as medidas provisórias manchadas dessa ilegalidade. Sendo assim, o artigo discute quais os efeitos do contrabando legislativo e as interações institucionais Brasileiras sobre o tema. Com a prática corriqueira do contrabando legislativo os requisitos da relevância e urgência são, de certa maneira, burlados, pois há a inserção de matérias que não são relevantes e nem urgentes e que deveriam ser discutidas pelo processo legislativo comum. Outrossim, o costume inconstitucional das "caudas legislativas" ofende o regime democrático de direito, devido processo legislativo e a separação de poderes.Diante de todas essas características, o presente artigo pretende discutir todas as implicações que envolveram a decisão do SupremoTribunal Federal que emitiu um acórdão, a princípio, carecedorde eficácia.
The ruling by the Supreme Court in ADI 5,127 condemned the practice of "legislative tails" or jabutis amendments, which are the acts of inserting amendments that do nothave thematic relevance to the draft provisional measure proposed by the President of the Republic.It is a practice with serious defects of unconstitutionality, which was declared by the Supreme Court, however, the decision was modulated and did not affect the provisional measures tarnished by this illegality. Thus, the article discusses the effects of legislative smuggling and Brazilian institutional interactions on the subject.With the routine practice of legislative smuggling, the requirements of relevance and urgency are somewhat circumvented, as there is the insertion of matters that are neither relevant nor urgent and should be discussed by the common legislative process. Moreover, the unconstitutional custom of "legislative tails" offends the democratic rule of law, due legislative process and the separation of powers.Given all these characteristics, the present article intends to discuss all the implications that involved the decision of the Federal Supreme Court that issued a decision, in principle, lacking effectiveness.
