O presente trabalho propõe uma leitura da história do direito internacional por meio das chaves conceituais da teoria da Justiça de Nancy Fraser. Defendemos que o conceito de sustentabilidade, ápice das deliberações globais sobre meio ambiente e desenvolvimento, é um resultado normativo da polÃtica pós-westphaliana que, no âmbito jurÃdico, concretiza o princÃpio polÃtico democrático radical de Nancy Fraser da igualdade de participação paritária na vida social em âmbito transnacional.
This paper aims a historical reading of international environment law under the key concepts from Nancy Fraser philosophy. I argue that the concept of sustainability is the climax of global deliberations about environment and development. Sustainability Ãs the normative product of pos-westphalian politics wich, in the politics realm, set out the radical democratic principle of Nancy Fraser that is egalitarian participation in the social life, now, in the transnational frame.Keywords: international Law, sustainability, politics.
