A crise europeia dos refugiados fez emergir um dos problemas centrais dos Direitos Humanos, o reconhecimento do outro como sujeito de direitos, respeitando sua singularidade. Essa questão de como lidar com a diversidade sobre aspectos fundamentais da vida humana é um pressuposto na discussão sobre os direitos humanos. Trata-se, na verdade, de uma discussão sobre a relação entre igualdade e direitos humanos. Por isso, organismos internacionais já precisaram se manifestar nessa matéria. No Sistema Interamericano de Direitos Humanos o marco dessa discussão é a Opinião Consultiva nº 18/03. Considerando essa manifestação, o objetivo do presente trabalho é analisar como se dá a relação entre igualdade e direitos humanos em um contexto em que o contato com o Outro é marcado pela diversidade e pelo desafio de reconhecimento sem eliminação da identidade. A metodologia empregada foi de pesquisa bibliográfica.
The European Refugee Crisis gave rise to a central problem for Human Rights, recognition of the other as subject of rights respecting their uniqueness. This question of how to deal with diversity on fundamental aspects of human life is an assumption in the discussion on human rights. It is actually a discussion on the relationship between equality and human rights. Therefore, international organizations needed already manifest in this area. The milestone of this discussion in the Inter-American Human Rights System is the Advisory Opinion nº 18/03. Considering this opinion, the aim of this study is to analyze how is the relationship between equality and human rights in a context in which contact with the Other is marked by diversity and the challenge of recognition without eliminating identity. The methodology used was literature search.
