Partindo-se da visão dos direitos fundamentais como garantias reconhecidas pela Constituição do 1988 que estabelecem condições mínimas à população no campo social, levantam-se alguns pressupostos em que o princípio da solidariedade, descrito no artigo 3º da Constituição de 1988 como um contributo imbuído de valor moral e ético, apresenta-se como expressão valorativa dos preceitos fundamentais na medida em que os direitos sociais são notadamente sustentados por deveres de solidariedade. O valor-solidariedade, entendido como um conjunto de princípios e valores, coloca-se a serviço de uma jurisdição compromissada com a realidade ciente da crise de solidariedade. Por meio de uma hermenêutica filosófica, aberta e valorizadora das peculiaridades que cada texto propõe é que se estabelecerá a ligação entre os direitos fundamentais e a solidariedade. Por meio do método hermenêutico trazem-se alguns pressupostos que compreendam o princípio da solidariedade como expressão valorativa para a realização dos direitos sociais.
Starting of the vision from fundamental rights while recognized warraties by the Constitution of 1988 that they establish minimum conditions to the population in the social field, they will be lifted up some pressuposed where the beginning of the solidarity, described in the 3rd article of the Constitution of 1988 as a dipped contribution of ethical and moral value, it comes as value expression of the fundamental precepts in the measure in that the social laws especially sustained by solidarity duties. The value-solidarity, expert as a group of beginnings and values if it puts to service of a compromised jurisdiction with the aware reality of the solidarity crisis. Through a hermeneutics philosophical, open and valorized of the peculiarities that each text proposes it is that it will settle down the connection between the fundamental rights and the solidarity. Through the hermeneutics method some will be brought pressuposed that understand the beginning of the solidarity as expression valorativa for the accomplishment of the social laws.
