O artigo analisa como o Superior Tribunal de Justiça está aplicando os precedentes vinculantes, após ao advento do novo Código de Processo Civil no direito penal e processual penal. O problema apresentado para a pesquisa foi se o Superior Tribunal de Justiça, enquanto corte de precedentes, respeita os precedentes horizontais e verticais, bem como produz precedentes para a uniformização do direito e, por conseguinte, traz maior segurança jurídica ao ordenamento jurídico. Foi apresentado um questionário aos Ministros do Superior Tribunal de Justiça, bem como realizou-se uma análise de casos julgados pela corte especial e pela terceira seção. Ao final, conclui-se que há em andamento uma alteração do sistema jurídico brasileiro, pois os ministros estão aplicando os precedentes vinculantes em seus julgamentos, o que pode acarretar maior previsibilidade, igualdade e segurança jurídica.
The article examines how the Superior Court of Justice is applying binding precedents after the advent of the new Code of Civil Procedure in criminal and procedural criminal law. The problem presented for the research was whether the Superior Court of Justice, as a precedent court, respects horizontal and vertical binding precedents, as well as producing binding precedents for the uniformity of law and, therefore, brings greater legal certainty to the legal system. A questionnaire was presented to the Ministers of the Superior Court of Justice, as well as an analysis of cases judged by the special court and the third section. In the end, it is concluded that there is an ongoing change in the Brazilian legal system, as the ministers are applying the binding precedents in their judgments, which may lead to greater predictability, equality and legal certainty.
