O presente artigo dedica-se a uma análise, sob a metodologia de revisão bibliográfica, sobre a efetivação do direito a dignidade humana e a proteção ao consumidor sob a ótima dos direitos fundamentais e os mecanismos de proteção do consumidor no Mercado Comum do Sul – Mercosul. Para tanto, percorre brevemente um histórico das ações tomadas pelo bloco econômico na proteção do consumidor mercosulino desde a sua criação até o projeto de Acordo do Mercosul sobre o direito aplicável aos contratos de consumo, com o objetivo de se analisar a construção das medidas protetivas estabelecidas pelos comitês especializados na matéria do Direito do Consumidor para verificar-se que mesmo que haja uma vontade de se legislar e padronizar o tratamento dos consumidores nos países integrantes do bloco, conclui-se que ainda é necessário um maior aprofundamento da questão, que depende de vontade política, econômica e diplomática.
This article is dedicated to an analysis, under the methodology of bibliographic review, on the realization of the right to human dignity and consumer protection under the optimum of fundamental rights and consumer protection mechanisms in the Southern Common Market – Mercosur . To this end, it briefly covers a history of the actions taken by the economic bloc in protecting the Mercosur consumer from its creation to the Mercosur Agreement project on the law applicable to consumer contracts, with the objective of analyzing the construction of the established protective measures by the specialized committees in the field of Consumer Law to verify that even if there is a desire to legislate and standardize the treatment of consumers in the countries that are part of the bloc, it is still necessary to go deeper into the issue, which depends on political and economic will and diplomatic.
