A regulamentação da nova Lei de Migração trouxe um tratamento mais digno e humanitário aos migrantes que vivem no Brasil, englobando também uma proteção maior aos indivíduos em risco humanitário, como os refugiados. A questão dos refugiados é uma discussão atual e de extrema importância frente a uma crise de refugiados que o mundo vem passando. A nova legislação brasileira se mostrou indo na direção oposta do que se tem sido feito por outros países, principalmente nos Estados Unidos e na Europa, uma vez que é uma resposta mais humana a esse dilema. Além disso, a nova lei está em consonância com compromissos humanitários internacionais assumidos pelo Brasil. Por isso, o presente trabalho irá retratar a proteção dada aos refugiados pela nova Lei de Migração, e, através de um estudo de caso dos refugiados venezuelanos no Brasil, verificar o grau de eficácia desta lei.
The regulation of the new Migration Law has brought a more dignified and humane treatment to migrants living in Brazil, including greater protection for individuals at humanitarian risk, such as refugees. The issue of refugees is a current and extremely important discussion in the face of a worldwide refugee crisis. The new Brazilian legislation has turned to the opposite direction from what has been done by other countries, especially the United States and Europe, since it is a more humane response to the refugee dilemma. In addition, the new law is aligned with international humanitarian commitments assumed by Brazil. Therefore, this study will portray the protection given to refugees by the new Migration Law, and, with a case study of Venezuelan refugees in Brazil, it will verify the effectiveness of this law.
