O artigo tem como foco central a tensão entre o papel do Supremo Tribunal Federal como legislador negativo em casos de controle de constitucionalidade difuso e os limites da jurisdição no uso da mutação constitucional. Por meio de revisão bibliográfica e de análise de decisões da Corte Constitucional, foi possível chegar a duas conclusões fundamentais que dizem respeito, primeiro, a um novo formato de controle de constitucionalidade difuso e, por segundo, o ativismo judicial decorrente da extrapolação dos limites da jurisdição constitucional pela técnica da mutação constitucional.
The article focuses on the tension between the role of the Federal Supreme Court as a negative legislator in cases of diffuse constitutionality control and the limits of jurisdiction in the use of constitutional mutation. Through a bibliographical review and analysis of decisions of the Constitutional Court, it was possible to arrive at two fundamental conclusions that relate, first, to a new diffuse constitutionality control format, and secondly, judicial activism resulting from the extrapolation of the limits of constitutional jurisdiction by the technique of constitutional mutation.
