A reforma penal espanhola de 2015 introduziu no Código Penal uma injustificável, desproporcionada e contraditória “prisão permanente revisávelâ€, pois a prisão permanente não é passÃvel de revisão. Na realidade, sob a denominação eufemÃstica é ocultada a prisão perpétua, um termo que é evitado pela manifesta inconstitucionalidade desta punição. A prisão perpétua deveria ser rejeitada porque é propagandÃstica, midiática, demagógica, populista, irracional, ineficaz, desnecessária, discriminatória, incerta, ao contrário da segurança jurÃdica, da reabilitação ou reintegração, e por último mas não menos importante, deveria ser abolida porque viola a dignidade humana. A prisão perpétua não é uma penal para a era global, porque a punição deveria respeitar o princÃpio da humanidade, a exigência inevitável para se entrar na era da globalização. Em suma, o melhor argumento contra a prisão perpétua é de que não há nada a seu favor. Portanto, deveria ser evitado o abuso de poder punitivo por parte do Estado desproporcional, extremo, excessivo, selvagem ou o castigo brutal, e, para tanto, é necessário acabar com a prisão perpétua no mundo. Assim, eu proponho um acordo de fraternidade entre todos os professores de direito penal para lutar pela abolição da prisão perpétua no mundo.
The 2015 Spanish penal reform introduced in the Criminal Code an unjustifiable, disproportionate and contradictory “reviewable permanent prisonâ€, because the permanent is not reviewable. In fact, under the euphemistic denomination is concealed the life imprisonment, a term that is avoided by the manifest unconstitutionality of this punishment. The life imprisonment should be rejected because is propagandistic, mediatic, demagogic, populist, irrational, ineffective, unnecessary, discriminatory, uncertain, contrary to legal security, rehabilitation or reintegration, and last but not least the life imprisonment should be abolished because it violates the human dignity. Life imprisonment is not a penalty for the global era because punishment should respect the principle of humanity, the inevitable requirement to enter the era of globalization. Humanity is the measure of justice of punishment and of fair criminal regulation. In sum, the best argument against life imprisonment is that there is no reason in its favor. Therefore should be avoided the abuse of the punitive power of the state, disproportionate, extreme, excessive, savage or brutal punishment and it is necessary to end the life imprisonment in the world. Thus I propose an agreement of brotherhood among all the professors of criminal law to fight for the abolition of life imprisonment in the world.
