Este artigo visa discutir a influência e importância ao meio jurídico das telenovelas no cenário social brasileiro. Assim, a discussão perpassa pela responsabilidade do Estado no entretenimento televisivo questionando o seu viés de atuação, uma vez que o pensamento criativo não deve ser regulado, mas sim, outras condições que garantam o Estado democrático de direito e a titularidade dos direitos humanos. Portanto, as telenovelas indicam os costumes e comportamentos sociais na televisão e demonstram aquilo que a sociedade está apta ou prefere compreender, assim, o problema da falta de representatividade se encontra na sociedade real, e não na narrativa ficcional da telenovela. Para tanto, foi usado o método hipotético-dedutivo, valendo-se de casos concretos para ilustrar o raciocínio.
This article discusses about the juridical influence of soap operas in the Brazilian social scene. Thus, this discuss talks about the State responsibility in the TV entertainment asking for its meaning, proving that creative thinking don’t be ruled, but the others conditions that makes the Democratic State and the Human Rights. So, the soap operas show the social traditions and habits and makes what the society is able to understand or not, so the problem of representativeness is on real society, and it is not in fictional narrative. For this, the hypotheticaldeductive method was used added with some cases to demonstrate its aim.
