O artigo tem como objetivo analisar os direitos fundamentais dos portadores de transtornos mentais no sistema público de saúde do Brasil. Dessa forma, no primeiro capítulo, o trabalho trata da evolução da normatização sobre saúde psiquiátrica no país e estuda as principais normas sobre tratamento de pessoas com doenças mentais e suas mudanças, com objetivo de garantir os direitos fundamentais dos pacientes. A abordagem analisa o movimento pela Reforma Psiquiátrica iniciada com o objetivo de modificar as normas para tratamento de saúde mental, tendo em vista que o tratamento de doenças psiquiátricas no Brasil comumente não observava os direitos fundamentais básicos, como liberdade, dignidade da pessoa humana, integridade física e saúde do paciente durante o tratamento. Analisa a evolução das normas sobre o tema até os dias atuais, especialmente alterações e propostas recentes para permitir, entre outras mudanças, internações manicomiais. Ao final, avalia-se a possibilidade de as referidas mudanças implicarem retrocessos na política de saúde mental brasileira. Adotou-se o método dedutivo por meio da análise de conteúdo e da revisão bibliográfica de livros e artigos relativos ao tema abordado.
The article aims to analyze the fundamental rights of the people with mental problems in the Brazilian public health system. Therefore in the first section the article adresses the evolution of the legislation concerning psichiatric health in Brazil. So we studied the public policies that concern psychiatric treatments and how it changes to garantes of the fundamental rights of the patients. The study highligts the movement called psychatric reform which started in order to change the rules aimed at the treatments of mental diseases. Prior to this movement, the treatment of psychiatric deseases did not respect the fundamental rights as liberty, dignity, physical integrity and health during the therapy. Despite the psychiatric reform, that improved mental health treatments in Brazil and it´s regulation, recently the goverment has been trying to change the previously mentined regulation in order to allow admission of the considered patients in psychiatric facilities once again. At last the article analyzes these changes that can be considered a step back in the Brazilian mental healh policy. As a methodological procedure, this article has used a deductive approach through content analysis and bibliographical revision of books and articles related to the theme.
