A segurança jurídica é essencial para uma vida estável, sendo que ela reclama, muito além da previsibilidade, a efetiva tutela dos direitos fundamentais. Nesse sentido, o objetivo do presente trabalho é o de demonstrar que, ainda que previsível ou calculável, um ambiente jurídico fica longe de ser seguro se não tutela concretamente os direitos de todos, mormente os daqueles que estão em situação de desamparo. Para o alcance do aludido desiderato, o estudo baseia-se em pesquisa qualitativa, sendo utilizado o método dedutivo em perspectiva crítica. A sua conclusão assentou que a segurança jurídica não milita somente em favor do capital econômico, mas, também, e, sobretudo, em favor das parcelas vulneráveis da sociedade.
Law security is essential for astable life, and it is certain that it demands, far beyond predictability, the effective protection of fundamental rights. Thus, the aim of the present paper is to demonstrate that, even if predictable or calculable, a legal environment is far from secure if it does not materiallyprotect the rights of all, especially those who are in a situation of helplessness. To fulfill the mentioned desideratum, the study is based in qualitativeresearch; being used the deductive method in a critical perspective. The conclusion settled that the law security does not just advocate only in favor of the economic capital, but,also, and above all, for the vulnerable parts of society.
