O presente trabalho tem o objetivo central de analisar, de forma concisa, o embate entre a legitimidade e a legalidade do direito à associação sindical no trabalho do policial militar, considerando a mediação e as audiências públicas, bem como os princípios constitucionais, como um direito à liberdade de expressão e garantia da dignidade humana. Analisar-se á, para tanto os aspectos positivos e negativos, fatores sociais sobre o tema, com seus possíveis desdobramentos e consequências. Igualmente, o doutrinário e jurisprudencial, que irão nortear as reflexões ora empreendidas, serão objeto de estudo. Para tanto, será desenvolvida pesquisa teórica utilizando-se como instrumento livros, sites e artigos publicados, bem como o método será o dedutivo.
The present work has the central objective of analyzing, in a concise way, the conflict between the legitimacy and the legality of the right to union association in the work of the military police, considering mediation and public hearings, as well as constitutional principles, as a right to freedom of expression and guarantee of human dignity. To analyze, for both the positive and negative aspects, social factors on the subject, with its possible consequences and consequences. Likewise, the doctrinal and jurisprudential, which will guide the reflections that have been undertaken, will be the object of study. For this, theoretical research will be developed using as an instrument books, websites and published articles, as well as the method will be the deductive.
