Há alguns fatores que influenciam as tendências interpretativas da Corte Interamericana de Direitos Humanos ("Corte IDH"). Este trabalho possui como objetivo compreender os aspectos fundamentais que levam a Corte IDH a priorizar uma interpretação extensivamente protetiva, teleológica e evolutiva, e, consequentemente, de que forma as normas de interpretação do Artigo 29 da Convenção Americana de Direitos Humanos ("CADH") são aplicadas na jurisprudência da Corte IDH. Para tanto, é preciso que se compreenda o contexto em que o Sistema Interamericano de Direitos Humanos, a Convenção Americana, a Comissão e a Corte IDH foram estabelecidos. Mister faz-se a percepção da interpretação própria dos tratados de direitos humanos, em decorrência de seu caráter especial. Posteriormente, abordar-se-ão os fatores que influenciam as tendências interpretativas da Corte IDH e, em sequência, será feita uma análise específica do Princípio Pro Homine. Finalmente, serão demonstradas o que se denomina "múltiplas funções" do Artigo 29 da CADH.
There are some factors that influence the interpretative tendencies of the Inter-American Court of Human Rights ("Inter-American Court"). The purpose of this study is to understand the fundamental aspects that lead the Inter-American Court to prioritize an extensively protective, teleological and evolutionary interpretation, and consequently how the rules of interpretation of Article 29 of the American Convention on Human Rights ("ACHR") are applied in the jurisprudence of the Inter-American Court. Therefore, it is necessary to understand the context in which the Inter-American Human Rights System, the American Convention, the Commission and the Inter-American Court were established. The perception of the proper interpretation of human rights treaties, due to their special character, is vital. Subsequently, will be discussed the factors that influence the interpretative tendencies of the Inter-American Court and, subsequently, a specific analysis of the Pro Homine Principle will be made. Finally, what is called the "multiple functions" of Article 29 of the ACHR will be demonstrated.
