O presente artigo analisa o sistema probatório – tanto civil, quanto penal, pois não havia essa distinção à época – no período da Alta Idade Média, principalmente na Europa central, mas também trazendo a lume os costumes de outras organizações sociais politeístas que apresentavam o sistema probatório das ordálias ou também chamados de Juízos de Deus.
Inicialmente, se faz uma breve descrição da origem e do desenvolvimento do direito canônico, assim como a distinção entre este e o direito eclesiástico, para, em seguida, analisar as ordálias e suas características, bem como as circunstâncias que cominaram na sua extinção.
This essay aims to analyze the evidential system – in both civil and criminal law, because it was not usual to differentiate them at that time – in the period known as the High Middle Age. We focused in the central Europe, but some information about other polytheist societies, which also used the Judgments of Gods as a way of evidence, was brought. In the beginning, there is a brief description on the origins of the Canon Law. After that, we analyze the Judgments of God and its features, also the circumstances of its ending.
