Muito tem se discutido sobre a gestão democrática no contexto escolar e, após anos de lutas, a Constituição Federal de 1988 homologou o que há tempos era esperado, a implantação de leis para instituir uma educação de qualidade para todos os cidadãos, com igualdade de condições e permanência para toda a população e a oportunidade da participação da comunidade no ambiente escolar nas tomadas de decisões. Este artigo propõe uma análise das principais leis federais a respeito da educação e da democratização do ensino. A princípio é abordado a Constituição Federal de 1988, a primeira a garantir igualdade entre todos os cidadãos e em sequência como foi garantido esse direito na educação através da Lei de Diretrizes e Bases da Educação/LDB. Com a efetivação das leis e a garantia a todos das mesmas oportunidades, o artigo pretende evidenciar se realmente o Estado tem promovido a igualdade na sociedade, garantindo uma educação de qualidade ou há uma falsa ideia de que tudo tem sido feito como se prevê nas principais legislações educacionais.
Much has been discussed about democratic management in the school context and, after years of struggles, the Federal Constitution of 1988 ratified what had long been expected, the implementation of laws to establish quality education for all citizens, with equal conditions and permanence for the entire population and the opportunity for the community to participate in the school environment in decision-making. This article proposes an analysis of the main federal laws regarding education and the democratization of teaching. At first, the Federal Constitution of 1988 is approached, the first to guarantee equality among all citizens and, in sequence, how this right was guaranteed in education through the Law of Guidelines and Bases of Education / LDB. With the implementation of the laws and the guarantee to all of the same opportunities, the article intends to show if the State has really promoted equality in society, guaranteeing a quality education or there is a false idea that everything has been done as foreseen in the main educational legislation.
