O presente trabalho tem por fim discutir algumas questões procedimentais no Sistema Interamericano de Direitos Humanos, mais especificamente, as condições de admissibilidade de uma denúncia e de um caso perante a Comissão Interamericana e a Corte Interamericana, respectivamente. Comparações com outros sistemas internacionais serão feitas para melhor compreender o sistema interamericano. As exceções às condições de admissibilidade serão estudadas para que a proteção dos direitos humanos seja mais eficaz. Pretende-se, assim, demonstrar que a correta utilização dos instrumentos disponíveis é fundamental para o pronto combate às violaçõescometidas.
This paper aims to study proceeding rules in the Inter-American Human Rights System, especially, conditions for admissibility of a case before the Commission and the Court. Some comparisons with other international human rights systems are drawn, in order to better understand the Inter-American System. It also studies the exceptions to those conditions for admissibility, for the purpose of allowing a faster and more effective protection of the human rights. This work intends to show how the legal instruments at our disposal, when properly handled, are indispensable to the endeavor of human rights protection.
