A pandemia provocada pelo novo coronavírus tem afetado a vida dos portadores de deficiência que atuam direta ou indiretamente junto ao Judiciário e daqueles que necessitam do acesso à justiça para a efetivação dos seus direitos. O estudo objetiva analisar o tratamento dispensado pelo sistema de justiça estatal, durante a atual crise sanitária, às pessoas com necessidades especiais, considerando a possibilidade de lesão a direitos fundamentais, mesmo com a abrangente normatização sobre o tema, inclusive no âmbito internacional, constitucional, legal e infralegal. Utilizando-se do método hipotético-dedutivo e da revisão de literatura, concluindo que as falhas estruturais observadas e a falência ou inaplicabilidade das políticas públicas com relação a esse grupo configuram um “estado de coisas inconstitucional”, demandando a atuação urgente e coordenada de uma pluralidade de atores e órgãos estatais.

A pandemic caused by the new coronavirus has affected the lives of people with disabilities who work directly or indirectly with the judiciary and those who have access to justice to enforce their rights. The study aims to analyze the treatment provided by the state justice system, during the serious health crisis caused by the new coronavirus, to people with disabilities, considering the possibility of injury to fundamental rights, even with the comprehensive regulation on the theme, including at the international, constitutional, legal and infralegal levels. Using the hypothetical-deductive method and literature review methods, it is concluded that the structural failures observed and the bankruptcies or inapplicability of public policies in relation to this social group constitute an “unconstitutional state of things”, demanding the urgent and coordinated action of a plurality of actors and state bodies.
