Este artigo, de caráter dedutivo einterdisciplinar, desenvolvido através de pesquisa bibliográfica e análise documental, tem por objetivos gerais analisar o Estatuto de Roma, o Tribunal Penal Internacional, o contexto histórico, jurídico e político da Ditadura Militar e os crimes praticados durante tal ditadura, em especial sob a ótica do Estatuto de Roma. Os resultados apresentam-se com a análise dos avanços do Estado argentino em relação aos direitos humanos, desde o contexto da ditadura militar.

This article, of deductive and interdisciplinary character, developed through literature search and document analysis, aims to generally analyze the Rome Statute, the International Criminal Court, the historical, legal and political character of the military dictatorship and the crimes committed during the dictatorship, specifically from the perspective of the Rome Statute. The results are presented with an analysis of the progress of the Argentine state in relation to human rights, since the context of the military dictatorship.
