Busca-se no presente trabalho analisar a influência do patriarcado e dos preconceitos de gênero no ordenamento jurídico brasileiro, seja nas leis, na doutrina ou na jurisprudência. São te- cidas noções históricas sobre a condição da mulher na sociedade, bem como levantados apontamentos formulados por teóricos em torno das categorias de gênero, sexualidade, controle social e violência e como elas se relacionam com o patriarcado. A influência do sistema patriarcal sobre o Direito, e o quanto este pode atuar, por vezes, para a perpetuação daquele, é observada a partir de exemplos colhidos na legislação, nos estudos doutrinários e na ela- boração de decisões judiciais. Em seguida, aborda-se a teoria fe- minista do Direito, que procura questionar os alicerces patriarcais que influenciam o Direito ainda nos dias atuais, e sua busca em contribuir para modificar o ponto de vista androcêntrico a partir do qual é produzido o Direito. A conscientização acerca da problemática trazida pelos operadores do Direito pode contribuir para uma sociedade mais igualitária entre mulheres e homens.
The present work seeks to analyze the influence of patriarchy and gender prejudices in the Brazilian legal system, whether in laws, doctrine or jurisprudence. Historical notions about the condition of women in society are woven, as well as notes made by theorists around the categories of gender, sexuality, social control and violence and how they relate to patriarchy. The influence of the patriarchal system on the Law, and how much it can contribute, at times, for the perpetuation of patriarchy, are observed from examples gathered from the legislation, the doctrinal studies and the elaboration of judicial decisions. Then, the feminist theory of Law is approached, which seeks to question the patriarchal foundations that influence Law even today, and its search to contribute to modify the androcentric point of view from which Law is produced. Awareness about the issue brought up by Law enforcement officers can contribute to a more egalitarian society between women and men.
