Tanto o ativismo jurídico como a judicialização da política tornaram-se eventos presentes no interior da sociedade brasileira, como também em outras sociedades políticas do Ocidente, que se prestem ao mínimo necessário as formas das análises comparadas com o caso brasileiro. A judicialização da política, concebida como tratamento dos conflitos sociais em termos jurídicos em seus contraditórios efeitos sobre o exercício dos poderes, apoiando-se sobre a norma constitucional, se contrapõe aos resultados alcançados pela práxis política, descaracterizando as tendências que essas enunciam frente à reprodução da sociabilidade capitalista. Por seu turno, as características institucionais definidoras que demonstram a tensão que se dá nas diversas conjunturas entre o fazer do Direito e as prospecções da Política, em geral, a judicialização da política convive contraditoriamente com as diversas roupagens do ativismo judicial. Neste caso, justifica-se como uma maneira de intervenção sobre os temas políticos e suas práticas, visando implementar os esclarecimentos sobre os direitos, supondo a realização do justo para a sociedade como um todo. O que segue é uma tentativa de abordar a ambiguidade entre ambos os temas e explorar a entrada em cena da judicialização da política nos termos de oposição e conformação do regime democrático brasileiro, após a Constituição Federal de 1988, contrapondo-a a dinâmica do ativismo jurídico nesse momento histórico. Os três capítulos expostos objetivam identificar como o movimento das contradições do capitalismo produz as formas sociais historicamente determinadas inscritas nos eventos analisados.

Both judicial activism and the judicialization of politics have become present events whitin brazilian society, as well as in other Western political societies, which lend themselves to the necessary forms of analysis compared to the brazilian case. The judicialization of politics, conceived as the treatment of social conflicts in legal terms and its contradictory effects on the exercise of powers, relying on the constitucional norm, is in contrast to the results achieved by political práxis, uncharacterizing the tendencies they enunciate in relation to reproduction of capitalist sociability. In turn, the defining institutional characteristics that demonstrate the tension that occurs in the various conjunctures between the making of law and the prospects of politics, in general, the judicialization of politics coexists with the various guises of judicial activism. In this case, it is justified as a way of intervention on the political issues and their practices, aiming to implement the clarifications on the rights, assuming the realization of the Just for society as a whole. What follows is na attempt to address the ambiguity between both themes and explore the entry into the scene of the judicialization of politics in terms of the opposition and conformation of the brazilian democratic regime after the Federal Constitution of 1988, conteuracting it the dynamics of legal activism at this historical moment. The three exposed chapters aim to identify how the movement of the contradictions of capitalismo produces the historically determined social forms inscribed in the events analyzed.
