A partir do pressuposto epistemológico da teoria neo-institucional, para quem as Instituições estimulam o desenvolvimento econômico ao reduzir incertezas e riscos, este artigo aborda a relevância das Instituições e dos Direitos de Propriedade Intelectual como importante elemento na atração de Investimentos Diretos Externos com maiorvalor agregado por parte das Empresas Multinacionais. Estas empresas demandam fortalecimento do ambiente Institucional, o que implicaentre outros aspectos, a adequada proteção dos Direitos de Propriedade Intelectual. Neste contexto, a problemática objetode investigação deste artigo reside na necessidade de superar as atuais deficiências do cenário brasileiro, reforçando os Direitos de Propriedade Intelectual como forma de atração de multinacionais com estratégias diferenciadas de investimento.

Based on the new-institutional theory, which considers that institutions promote economic development by reducing risks and uncertainties, the present article aims at discussing how institutions and, particularly intellectual property rights, can representan important factor of attracting high value added Foreign Direct Investment of Multinational Enterprises. These companies require the strengthening of the institutional environment, which implies among other, adequate protection of intellectual property rights. In this context, the problematic object of investigation of this article is the need to overcome the current shortcomings of the Brazilian context, particularly by strengthening the Intellectual Property Rights in order to attract multinationals with distinctive investment strategies.
