A presente pesquisa se dispôs a um debate aberto, veiculando elementos jurídicos esociais, a fim de compreender alguns traços deste novo contexto digital nas relações humanas. Oestudo se pauta pela imprescindível efetivação do direito à informação, com relevo diferenciadoao seu acesso, ao mesmo tempo em que se compactua de uma sociedade da informação, compluralidade de opções ao cidadão, questionando-se como a noção de sociedade de risco podeinfluenciar este processo comunicativo que vem rompendo barreiras comunicativas entre os sereshumanos. Desta maneira, compreende-se que muitos dos temores levantados pela sociedade derisco são capazes de desacelerar o processo inclusivo da sociedade da informação, sendo que sedeve repensar algumas posturas em relação à internet, para recrudescer o desenvolvimentoinformativo, em contraposição às posturas punitivas, restritivas, prolatoras de um discurso demedo que afasta determinados cidadãos da inclusão digital.

The presente research set out to an open debate, conveying the legal and social order to understand some features of this new digital environment in human relations. The study is guided by the essential realization of the right to information, while enhancing their access to the differential, while that condone an information society with a plurality of options to citizens, questioning the notion of risk society can influence this communication process that is breaking communication barriers between human beings. Thus,it is understood that many of the fears raised by the risk society are able to slow the process inclusive information society, and should rethink some attitudes toward the Internet, to intensify the development of information,as opposed to punitive attitudes, restrictive prolator as a discourse of fear that keeps certain citizens of digital inclusion.
