Através de uma abordagem macroestrutural, utilizando o modelo jurisdicional democrático, o presente estudo traz uma análise do conceito de acesso à justiçaque se coaduna com o Estado Democrático de Direito e suas implicações na questão da eficiência jurisdicional / processual, bem como da implementação dos direitos fundamentais sociais na tutela coletiva. Para tanto, se faz necessária uma pesquisa analítica bibliográfica da literatura jurídica, com alguns elementos de direito comparado, utilizando-se o método indutivo e dedutivo.

Through broader structural approach, using the democratic judicial model, this study presents an analysis of the concept of access to justice that is consistent with democratic rule of law and its implications on the issue of judicial / procedural efficiency, as well as the implementation of the rights social rights in collective protection. For this purpose, it is necessary bibliographic analytical research of legal literature, with some elements of comparative law, using inductive and deductive method.
