O presente trabalho tem como objetivoanalisar o controle de convencionalidade das normas a fim de verificar a hierarquia conferida aos tratados de direitos humanos ratificados pelo Estado brasileiro. Não obstante, trouxe à baila o novo entendimento do Supremo Tribunal Federal com o julgamento do Recurso Extraordinário 466.343/SP, que trouxe uma evolução acerca da efetivação dos direitos humanos reconhecidos pelo Brasil em tratados internacionais, em consonância com os valores axiológicos constitucionais que informam a avançada Constituição Federal de 1988. Para tanto,utilizou-se como metodologia o tipo de pesquisa bibliográfico, como método dedutivo, por meio da análise textual, temática e interpretativa de obras jurídicas sobre o tema, assim como o tipo de pesquisa documental, enquanto método indutivo, por meio da análise de jurisprudências relacionadas à pesquisa.

This paper aims to analyze the conventionality control of standards to check the hierarchy given to human rights treaties ratified by the Brazilian state. Nevertheless , brought up the new understanding of the Supreme Court to the judgment of Extraordinary Appeal 466.343/SP, a development that brought about the realization of human rights recognized in international treaties in Brazil, in line with the constitutional axiological values that inform advanced Federal Constitution of 1988. For this purpose, was used as the type of methodology bibliographic research as deductive method, by textual, thematic and interpretative legal works on the subject analysis, as well as the type of document research, while inductive method, by analyzing of jurisprudence related to research.
