O “paper” analisa o Projeto Genoma Humano frente ao dever do Estado em promover as políticas públicas expressas na Declaração Universal do Genoma Humano e dos Direitos Humanos e na Constituição Federal de 1988. Primeiramente, o estudo demonstra que o Projeto Genoma Humano é uma pesquisa genética que, provavelmente, propiciará a realização de técnicas de engenharia genética, a qual é modalidade da biotecnologia moderna. Após, aborda os fundamentos éticos e constitucionais do genoma humano e a legislação que a regula. Por fim, busca tratar das políticas públicas na área de saúde, inserindo nestas àquelas referentes ao genoma humano, cuja obrigatoriedade e necessidade de adoção justificam-se pela efetivação e proteção de uma gama de direitos fundamentais envolvidos.

This paper analyzes the Human Genome Project with regard to State’s duty to provide public policies expressed in Human Genome Universal Declaration and Human Rights and Federal Constitution of 1988. First of all, the study shows that the Human Genome Project is a genetic research that will probably provide technical development in genetic engineering, which bring ethical issues in reference to modern biotechnology activity. Furthermore, it discusses ethics and constitutional bases of human genome and internal legislation that regulates genetic research activity. Finally, it tries to address public policies in health, adding them to those concerning human genome, whose mandatory condition and implementation need are justified by effectuation and protection of a number of fundamental rights involved.
