O STF entendeu ser possível alterar nome e sexo, mediante averbação no registro civil, independentemente de cirurgia de transgenitalização ou de ação judicial, em decisão proferida em março de 2018, na Ação Direta de Inconstitucionalidade 4.275, que modificou a interpretação do artigo 58 da Lei 6.015/1973. Este artigo versa sobre o confronto entre diferentes direitos de personalidade e a insegurança jurídica gerada pela decisão do STF. O tema central é discutir como ficam os vínculos jurídicos com terceiros que produziam efeitos no momento da mudança de nome e sexo e como se resolverão os casos em que houver conflitos com direitos fundamentais de outras pessoas. Como objetivos específicos, serão abordadas as origens, finalidade e legislação dos registros públicos e o direito ao esquecimento, por meio de um trabalho descritivo e exploratório de caráter qualitativo, com base em fontes doutrinárias e documentais.

The Supreme Federal Court (STF), the Brazilian highest court, recognized the right to change the name and sex on a birth certificate, regardless of sex reassignment surgery or judicial process, at the judgment of the Direct Action of Unconstitutionality (ADI) n.4,275, in March 2018, which modified the interpretation of article 58 of the Civil Registration Law (Law n. 6,015/1973). The aim of this paper is the confrontation between different rights of personality, not only of the one who disposed of the birth gender, but of third parties related to it, and also is about the legal uncertainty generated by the STF decision. The central theme is to discuss the legal relationship with third parties rights after the recognition of the name and sex change and how to deal with conflicts of fundamental rights of different people. As specific goals, there is the origins, purpose and legislation of the civil public registries and the right to be forgotten, through descriptive and exploratory work of a qualitative nature, based on doctrinal and documentary sources.
