O presente artigo dedica-se a observar o contexto prisional brasileiro e as consequências que o ambiente insalubre e hostil proporciona aos presos, bem como analisa as primeiras leis que regulamentaram a destacada situação até os dias atuais. Ato contínuo, é necessária a realização de uma delimitação ao grupo LGBTQ+, a vista que uns dos objetivos deste estudo é demonstrar a situação fática que vivenciam dentro cárcere e as consequências da criação de uma ala específica para o grupo. Portanto, o objeto de estudo deste trabalho é o passo inicial de uma longa trajetória que a comunidade LGBTQ+ enfrentará em busca do mínimo existencial dentro das prisões brasileiras. A pesquisa utilizou o método hipotético-dedutivo, com análise a obras jurídicas, artigos científicos, legislação pátria e outros materiais já publicados que se relacionam ao tema proposto, além de demonstrarem que a criação das alas LGBTQ+ impactam positivamente na convivência deste grupo enquanto estiverem encarcerados, pois, permite uma maior humanização da pena e respeito à sua identidade. É possível observar que a criação destas alas é, por ora, benéfica, mas, a longo prazo, serão necessárias outras políticas públicas que tenham o mesmo efeito, de modo a resguardar a identidade e integridade sem segregá-los dos demais prisioneiros.

ABSTRACT:This article is dedicated to observing the Brazilian prison context and the consequences that the unhealthy and hostile environment provides to prisoners, as well as analyzing the first laws that regulated the highlighted situation until today. Thereby, it is necessary to carry out a delimitation to the LGBTQ + group, one of the objectives of this study being to demonstrate the factual situation that they experience inside prison and the consequences of the creation of a specific wing for the group. Accordingly, the object of study of this work is the initial step of a long trajectory that the LGBTQ + community will still face in search of the minimum existential within Brazilian prisons. The research used the hypothetical-deductive method, with analysis of legal works, scientific articles, homeland legislation and other materials already published that relate to the proposed theme, in addition to demonstrating that the creation of LGBTQ + wings positively impacts the coexistence of this group while they are incarcerated because it allows a greater humanization of the penalty and respect to its identity. Therefore, it is possible to observe that the creation of these wards is, for now, beneficial, but, in the long term, other public policies that have the same effect will be necessary, in order to safeguard their identity and integrity without segregating them from other prisoners.
