O artigo aborda os fluxos migratórios envolvendo o Brasil, desde a sua colonização, passando pela imigração dos africanos e europeus, a diáspora brasileira, até os dias atuais. O estudo se vale das legislações brasileiras que estão ou já estiveram em vigor, com o objetivo de demonstrar como a diáspora brasileira influenciou o nosso movimento emigratório e importância da Lei de Migração na tutela dos emigrantes. Quanto à metodologia, para a realização do estudo, utilizou-se o método indutivo, de modo a se utilizar de uma premissa inicial para buscar respostas práticas à necessidade da tutela legal da política emigratória brasileira.

The article addresses the migratory flows involving Brazil, from its colonization, through the immigration of Africans and Europeans, the Brazilian diaspora, to the present day. The study will use Brazilian legislation that is or has already been in force, with the objective of demonstrating how the Brazilian diaspora influenced our migratory movement and the importance of the Migration Law in the protection of emigrants. As to the methodology, to carry out the study, it was applied the inductive method, in order to use an initial premise to seek practical answers justifying the need for legal protection of Brazilian immigration policy.
