Este artigo pretende examinar a proposta de Jeremy Waldron sobre como deveria funcionar a sistemática legal do discurso de ódio. Propõe-se uma revisão bibliográfica da teoria de Waldron. A partir da exposição das ideias do autor são tecidas críticas de seus adversários teóricos, dentre os quais se elege Brian Leiter como representante. Por meio da apreciação crítica e dialética das teses de Waldron e das objeções a elas levantadas, o artigo objetiva sustentar a fragilidade dos fundamentos teóricos da teoria de Waldron. Pretende-se demonstrar que são principalmente os pressupostos teóricos de uma filosofia política liberal presentes na teoria do autor os responsáveis pela inconsistência de sua tese.

This article intends to investigate Waldron's theoretical propositions about how a legal system should treat the hate speech. It is proposed a bibliographical review on Waldron’s theory. From the exposure of the author's main ideas, critical reviews are offered, among which this study chooses Brian Leiter's objections as representatives. By the critical and dialectical appreciation of these thesis and objections, this paper hopes to sustain the fragility of the theoretical foundations of Waldron’s theory. We intend to demonstrate that its theoretical fundaments, which are based on a liberal political philosophy, are the ones responsible for this theoretical inconsistence.
