A internet e as tecnologias telemáticas foram agentes alteradores do mercado, propondo uma nova economia mundial, baseada na informação. O novo espaço juntamente com a nova economia fomentaram empresas que detêm como seu único patrimônio a informação e a sua troca e veiculação. Dentro deste cenário, destacam-se os casos da Apple e o WhatsApp, que por sua postura protetiva com a informação de seus usuários, foram alvo de decisões judiciais que determinaram a abertura da comunicação de seus clientes para auxílio em investigações criminais. A postura adotada pelas empresas levou a medidas de desaceitação por parte de governos dos quais originaram as medidas. Neste cenário, discutiu-se o conflito entre fundamentos constitucionais, aplicando método de valoração para solução do conflito entre os mandamentos constitucionais para fim de resolução harmoniosa.

The internet and telematics technologies have been market-altering agents, proposing a new economy model to the world, based on information. This new space allied with the new economy model fostered companies that have as their sole asset the information and their exchange and placement. Within this scenario, we highlight the cases of Apple and WhatsApp, who for their protective stance with the information of their users, were the subject of judicial decisions that determined the opening of the communication of their clients for assistance in criminal investigations. The stance adopted by the companies led to measures of de-acceptance by the governments from which the measures originated. In this scenario, we discussed the conflict between constitutional foundations, applying a method of valuation to solve the conflict between the constitutional commandments in order to achieve a harmonious resolution.
