Como fito principal do presente estudo pretende-se analisar as vertentes que sustentam a argumentação jurídica da Corte maior do Poder Judiciário brasileiro, evidenciando o conflito de princípios fundamentais em matéria trabalhista, especificamente no que diz respeito à criação de discriminações positivas em razão do gênero no ordenamento jurídico trabalhista, passando sobre suas adversidades e principais motivos para continuar vigorando ou não frente o seguimento da teoria de Ronald Dworkin. Para isso, este trabalho utilizada do método dedutivo e comparativo quanto a análise de um caso em concreto.

The main purpose of this study is to analyze the aspects that underpin the legal argument of the Brazilian Judiciary’s major court, highlighting the conflict of fundamental principles in labor matters, specifically regarding the creation of positive discrimination on the grounds of gender in Brazil. Labor law, passing on its adversities and main reasons to continue or not in the face of the following of the theory of Ronald Dworkin. For this, this work uses the deductive and comparative method for the analysis of a specific case.
