Para o direito o empresário representa um ser sem definição positivada, maspragmaticamente pode ser reconhecido pelos contornos funcionais que o cotidiano lhe delineia,amplamente confirmados pelas concepções doutrinárias e jurisprudenciais. Não obstante, aempresa enquanto atividade desenvolvida pelo empresário possui responsabilidades das maisrelevantes; sendo exigível de forma efetiva a comprovação de sua função social, que por óbvio,não se confunde com suas responsabilidades sociais. Destarte, neste esboço, a investigaçãoregistrará seu foco na colisão entre as múltiplas variáveis com que a atividade empresária sevincula de forma positivada, em vários ramos do direito e a importância de se registrar odesenvolvimento da função social, embasando-se por oportuno na perspectiva econômica dodireito, sustentando-se no alicerce sobre o qual a empresa que não registre o cumprimento de talfunção, poderia até honrar com suas variáveis, mas encontrar-se-ia vazia de legitimidadesocioeconômica, passível, portanto de representar ônus ao Estado.
