A adoção intuitu personae ocorre quando os pais biológicos, ou um deles, expressam interesse em entregar diretamente o filho a uma pessoa ou família sem a obrigatoriedade de estarem inscritos no Sistema Nacional de Adoção e Acolhimento (SNA). A validade jurídica dessa modalidade é objeto de controvérsia doutrinária, embora a jurisprudência, incluindo a do Superior Tribunal de Justiça, venha admitindo a relativização da ordem cronológica do cadastro quando constituído vínculo socioafetivo entre o adotando e os adotantes. Este artigo examina como a presença do vínculo afetivo influencia decisões judiciais sobre adoção intuitu personae no âmbito do Tribunal de Justiça do Estado do Rio de Janeiro (TJRJ). Trata-se de pesquisa qualitativa, de natureza exploratória, desenvolvida por meio de revisão bibliográfica e de análise documental de 19 acórdãos e decisões monocráticas de segunda instância julgados entre 2014 e 2024, examinados em seu inteiro teor. O vínculo afetivo constituiu fundamento determinante em 13 das 19 decisões, amparando tanto a manutenção da criança no núcleo em que se encontrava quanto o seu afastamento. Nas decisões de deferimento, sua aferição apoiou-se sobretudo em indicadores relacionais; nas de indeferimento, prevaleceram o curto período de convivência e a tenra idade da criança, somados à insuficiência ou à divergência das manifestações técnicas. Conclui-se que a literatura da psicologia do desenvolvimento pode oferecer aporte complementar à qualificação dos critérios de aferição do vínculo.
Intuitu personae adoption occurs when the biological parents, or one of them, express the intention to hand over their child directly to a specific person or family, without the requirement that these individuals be registered in the National Adoption and Care System (SNA). The legal validity of this arrangement remains a matter of doctrinal controversy, although case law, including that of the Superior Court of Justice, has admitted the relaxation of the chronological order of the register where a socio-affective bond between the child and the prospective adopters has been formed. This article examines how the presence of an affective bond influences judicial decisions on intuitu personae adoption within the Court of Justice of the State of Rio de Janeiro (TJRJ). This is a qualitative, exploratory study based on a literature review and on documentary analysis of 19 appellate rulings and single-judge decisions handed down between 2014 and 2024, examined in full. The affective bond was the decisive ground in 13 of the 19 decisions, supporting both the child’s permanence in the household where they were living and their removal from it. In granting decisions, the bond was assessed mainly through relational indicators; in denying decisions, the short period of cohabitation and the child’s young age prevailed, together with insufficient or conflicting expert assessments. It is concluded that developmental psychology literature may offer a complementary contribution to refining the criteria used to assess the bond.
